Privacy Policy for POC Data Collector

This Privacy Policy describes how Luke Decker (“we,” “us,” or “our”) collects, uses, and shares information in connection with your use of our application (POC Data Collector) (the “App”), which utilizes Facebook Login for Business and integrates with Instagram. This policy is intended to inform you about our practices and your rights regarding your information when you use our App’s login features and interact with its functionalities.

We are committed to protecting your privacy and handling your data in an open and transparent manner. This Privacy Policy should be read in conjunction with Meta’s and Instagram’s own privacy policies and terms of service.  

1. Information We Collect

When you use Facebook Login for Business and/or connect your Instagram account through our App, we may collect the following types of information:

  • Information from Facebook:
    • Public Profile Information: This may include your name, profile picture, age range, gender, language, country, and other public information. The specific public information we receive is determined by your Facebook privacy settings.
    • Email Address: The primary email address associated with your Facebook account, if you grant us permission.
    • Business-Related Information (with your permission): If you use Facebook Login for Business to connect business assets (e.g., Facebook Pages, Instagram Professional Accounts, ad accounts, catalogs), we may collect information related to those assets. This could include:
      • Page IDs, Instagram Profile IDs
      • Access tokens necessary to manage these assets on your behalf within the App’s functionality.
      • Permissions you grant us to perform actions related to these assets (e.g., pages_read_engagement, instagram_basic, ads_management, catalog_management). We will only request permissions essential for the App’s described features.
  • Information from Instagram (with your permission):
    • Basic Account Information: Such as your Instagram username, profile picture, and account type (e.g., Business, Creator).
    • Content and Insights (with your permission): If you grant permissions, we may access your Instagram posts, stories, comments, and insights related to your content and audience (e.g., instagram_content_publish, instagram_manage_comments, instagram_manage_insights).
  • Information You Provide Directly: Any other information you voluntarily provide to us through the App, such as contact information for support or feedback.
  • Usage Data: We may collect information about how you use our App, such as features accessed, actions taken, and an error log for troubleshooting. This is typically anonymized or aggregated.
  • Device Information: We may collect general information about the device you use to access our App, such as device type and operating system, to help us provide a better user experience and for troubleshooting.

2. How We Use Your Information

We use the information we collect for the following purposes:

  • To Provide and Improve Our Services:
    • To allow you to log in to our App using Facebook Login for Business and connect your Instagram account.
    • To enable the features and functionalities of the App that you choose to use, which may involve accessing and managing your connected Facebook and Instagram assets as per the permissions you grant.
    • To personalize your experience within the App.
    • To analyze usage patterns and improve the App’s design, features, and performance.
    • To provide customer support and respond to your inquiries.
  • Communication:
    • To send you service-related announcements, updates, security alerts, and administrative messages.
    • To respond to your comments and questions.
  • Legal and Security Purposes:
    • To comply with applicable laws, regulations, and legal processes.
    • To protect our rights, privacy, safety, or property, and/or that of yours or others.  
    • To enforce our terms and conditions.
    • To prevent, detect, and investigate potentially prohibited or illegal activities, fraud, and security breaches.

3. How We Share Your Information

We do not sell your personal information. We may share your information in the following circumstances:

  • With Meta (Facebook and Instagram): Information is exchanged with Facebook and Instagram as a core part of the login and integration functionality. This sharing is governed by your privacy settings on those platforms and the permissions you grant to our App. We only use data received from Meta in accordance with their Platform Terms and Developer Policies.
  • Service Providers: We may share your information with third-party service providers who perform services on our behalf, such as hosting, data analytics, customer support, and email delivery. These service providers are authorized to use your information only as necessary to provide these services to us and are obligated to protect your information.  
  • Legal Requirements: We may disclose your information if required to do so by law or in the good faith belief that such action is necessary to comply with a legal obligation, protect and defend our rights or property, prevent or investigate possible wrongdoing in connection with the Service, protect the personal safety of users of the Service or the public, or protect against legal liability.  
  • Business Transfers: In the event of a merger, acquisition, reorganization, bankruptcy, or other similar event, your information may be transferred as part of the transaction, subject to standard confidentiality arrangements.  
  • With Your Consent: We may share your information for other purposes with your explicit consent.

We will not share the data obtained through Facebook Login for Business or Instagram integration with data brokers or for any advertising purposes unrelated to the direct provision of our App’s features that you have authorized.

4. Data Retention and Deletion

We will retain your personal information for as long as necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law, or until you request its deletion.  

You have the right to request the deletion of your personal data that we have collected. You can typically request data deletion by:

  • Revoking App Permissions: You can remove our App’s access to your Facebook and Instagram data through your Facebook and Instagram account settings. This will limit our ability to access further data but may not delete historical data we already hold.
  • Contacting Us: You can request the deletion of your data by contacting us at me@luke-decker.com. We will respond to your request in accordance with applicable law and Meta’s Platform Policies. Please note that we may need to retain certain information for record-keeping purposes, to complete transactions, or to comply with our legal obligations.  

5. Your Rights and Choices

Depending on your location and applicable laws, you may have certain rights regarding your personal information, including:  

  • Access: The right to access the personal information we hold about you.  
  • Rectification: The right to request correction of inaccurate personal information.
  • Erasure (Deletion): The right to request deletion of your personal information (as described in Section 4).
  • Restriction of Processing: The right to request that we restrict the processing of your personal information in certain circumstances.
  • Data Portability: The right to receive your personal information in a structured, commonly used, and machine-readable format.  
  • Objection to Processing: The right to object to our processing of your personal information in certain circumstances.  
  • Withdrawal of Consent: Where we rely on your consent to process your information, you have the right to withdraw that consent at any time.

We take reasonable administrative, physical, and technical safeguards to protect your personal information from loss, theft, misuse, and unauthorized access, disclosure, alteration, and destruction. However, no internet or email transmission is ever fully secure or error-free, so you should take special care in deciding what information you send to us.  

7. Children’s Privacy

Our App is not directed to individuals under the age of 13 (or a higher age threshold where applicable). We do not knowingly collect personal information from children. If we become aware that a child has provided us with personal information, we will take steps to delete such information. 8. International Data Transfers

Your information may be transferred to, and maintained on, computers located outside of your state, province, country, or other governmental jurisdiction where the data protection laws may differ from those in your jurisdiction. If you are located outside the United States and choose to provide information to us, please note that we transfer the data, including personal information, to the United States and process it there. Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.  

9. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page and updating the “Last Updated” date. You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page. Your continued use of the App after any modification to this Privacy Policy will constitute your acceptance of such modification.
